DAWKINS, District Judge.
This case was tried before a jury and resulted in a verdict for the plaintiffs, but on appeal, was reversed in part, because it was decided that the District Court had ruled erroneously upon the issue of prescription. In remanding the case, the Court of Appeals said: “The judgment ap-pealed from is affirmed so far as the verdict of the jury fixes the market value of the gas upon which plaintiff is entitled to recover royalties and so far as the court determined the amount due in reconvention. As to the amount determined by the court to be due plaintiffs it is reversed.…
