This matter is before the Court on cross-motions for summary judgment as to whether plaintiffs are entitled to payments totaling $1,734,906.40 and subject to a penalty of $26,-000 on account of their participation in the Department of Agriculture’s now-defunct Dairy Termination Program (“Program”). Congress authorized the Program in order to reduce the milk cow population, and hence the production of milk, in the United States.
