Appeal from an order of the Supreme Court (Nicandri, J.), entered November 2, 1990 in Franklin County, which granted petitioner’s application pursuant to General Municipal Law § 50-e (5) for leave to serve a late notice of claim.
Nicole Lamica was a seven-year-old student in the second grade at Davis Elementary School in the Town of Malone, Franklin County, when the school bus in which she was a passenger overturned on June 2, 1988.
