Appeal by the defendant from a judgment of the Supreme Court, Kangs County (Firetog, J.), rendered September 26, 2013, convicting him of murder in the second degree, criminal possession of a weapon in the second degree, and attempted aggravated assault upon a police officer, upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law, by vacating the conviction of attempted aggravated assault upon a police officer and the sentence imposed thereon; as so modified, the judgment is affirmed, and a new trial is ordered on count three of the superseding indictment…
