JOURNAL ENTRY AND OPINION

{¶ 1} Defendant-appellant, Eugene Hall ("appellant"), appeals the decision of the trial court. Having reviewed the arguments of the parties and the pertinent law, we hereby affirm the lower court and remand for correction of the journal entry.

{¶ 2} On September 22, 2005, the grand jury returned a two-count indictment against appellant. Count one charged appellant with rape in violation of R.C. 2907.02(A)(1)(b) and also alleged that the victim was under ten years old at the time of the act and that appellant compelled the victim to submit by force or threat of force.…
