G. M. Cook, a resident of Perry county, died intestate on December 27, 1921. On April 25, 1923, an action was instituted in the Perry circuit court under subsection 2, sec. 490, of the Civil Code of Practice, for a sale of the real estate belonging’ to the estate of Gr. M. Cook, deceased. Judgment for the sale of the land was rendered on August 23, 1923, and on October 1, 1923, it was sold by the master commissioner. The appellee, John E.
