DUFRESNE, Judge.
This lawsuit involves the alleged sale of a house and property. The defendant, Warren James Elmer, seeks our review of a judgment of the trial court declaring the sale a simulation.
On June 17, 1977, Sadie Fortunato and her husband, Henry (now deceased) executed an Act of Sale transferring one half interest in the property and house located at 131 Athania Avenue in Metairie, to then-adopted daughter, Paula Elmer, and her husband, Warren Elmer.
