In this action the complaint consisted of two counts. In the first it is alleged that on the 19th of January, 1924, at Marshfield, Wisconsin, an account was stated between the plaintiff and the defendant upon which a balance of $415.50 was found to be due from the defendant to the plaintiff, which the defendant then agreed to pay, but that no part thereof has been paid.
