Baden, justice of the peace, to dismiss an action at law for want of jurisdiction, and for a writ of prohibition restraining further proceedings. This is a petition for a writ of certiorari to review an order of the circuit court for the county of Kalamazoo. Respondent is a justice of the peace of the city of Kalamazoo elected under its charter as it existed in 1905. His term of office began on the second Monday in April, 1905, and will end the second Monday in April, 1909, or as soon thereafter as his successor is elected and qualified.
