CIRILLO, President Judge Emeritus:

¶ 1 The Commonwealth of Pennsylvania appeals from a judgment of sentence entered in the Court of Common Pleas of York County. We reverse.

¶ 2 After a jury trial, Appellee, Alvin Woodrow Tome, was convicted of possessing and operating illegal gambling devices, 18 Pa.C.S. § 5513, and selling malt or brewed beverages for consumption without a valid license, 47 P.S. § 4-492(2). 1 The trial testimony reveals that undercover Pennsylvania State Trooper Denise Kar-bowski attempted to gain entry to an establishment owned by Tome.
