Defendant was charged with (1) obtaining possession of a controlled substance by passing a forged prescription and (2) attempting to obtain possession of a controlled substance by passing a forged prescription. MCL 333.7407(l)(c); MSA 14.15(7407)(l)(c). On July 25, 1979, the district court judge granted defendant’s motion to quash the information. This order was affirmed by the circuit court on November 26, 1979. After the prosecution appealed to this Court, we affirmed. 110 Mich App 465; 313 NW2d 340 (1981).
