— The appellant brought this action to recover from the respondent the value of 62% tons of compressed wheat hay which it alleges belonged to it, and was lost through the carelessness and negligence of the defendant. The respondent put in issue both the allegation of ownership and the allegation of negligence. At the conclusion of the trial the court sustained a challenge to the sufficiency of the evidence, and directed a judgment for the respondent, on the ground that the evidence was insufficient to show title in the appellant to the property sued for.
