Süklivan, J.

The declaration charges the defendant below with speaking of the plaintiff these words: “You pilfeied money out of the store, and I can prove it.”—“You stole money.” The defendant pleaded not guilty.

On the trial, one witness proved that he heard Bechet say to Sterrett, you pilfered or filched money.- Whether he said pilfered or filched, the witness could not recollect.- At the" time of speaking the words, the parties were examining certain books of accounts and comparing them.
