Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County), to review a determination of the State Tax Commission, which denied petitioners’ application for redetermination of a deficiency or for a refund of personal income tax under article 22 of the Tax Law for the year 1972. Petitioners are husband and wife and residents of New Jersey. Petitioner, Joseph Chomyn, is a free lance director.
