This is a suit in which the plaintiff claims damages in the sum of $15,000 for the killing of her husband by a train of the defendant company.'
An exception of no cause of action was filed, predicated upon the grounds: (1) That a common-law marriage is not recognized in Louisiana, and is unknown to the laws of Louisiana, and therefore the plaintiff is not the widow of the deceased, and has no statutory or other legal right to claim damages on account of his death.
