This is an appeal from a judgment of the district court of Payne county. The action was instituted by the defendant in error, hereafter referred to as plaintiff, against the 'defendant or plaintiff in error, to recover damages for injuries alleged to have been inflicted upon the person and auto truck of the former ns the result of the latter’s negligent operation of a sedan automobile. The cause was tried to a jury upon the general issue raised by the pleadings of the two parties.
