This is a motion by claimant for summary judgment and a cross motion by the State seeking dismissal of the claim.

There are no disputes with respect to the essential facts.

The claimant was appointed as a member and chairman of the State Bingo Control Commission for terms of five years, the last of which expires on June 1, 1979.* This was pursuant to section 433 of the Executive Law which also provides that a member of the commission may be removed by the Governor for cause after an opportunity to be heard and that the chairman shall receive compensation fixed by the Governor within the amount…
