PHILLIPS, Circuit Judge.

On January 30, 1930, the National Life Insurance Company1 issued its policy of life insurance on Morris I. Jayne.2 The policy provided for total disability benefits.3

*360The Insurance Company brought this action against the insured, Lelia G. Jayne, his wife, the beneficiary, and Lelia Jayne, guardian of the person and estate of the insured, an incompetent.
