Robert Simmons appeals the trial court’s judgment upon a jury verdict finding him guilty of one count of unlawful merchandising practices in violation of the Missouri Merchandising Practices Act (“MMPA”) and imposing a six month sentence in the county jail. In two of his four points on appeal, Simmons claims that the trial court erred in denying his motion for acquittal at the close of all evidence.
