This suit arose under the provisions of the Workmen’s Compensation Act wherein Bert Morgan, an employee, sought to recover compensation of the Petroleum Casualty Company, an insurer, for personal injuries received in the course of his employment by the Humble Oil & Refining Company, the subscribing employer. The injury occurred on August 16, 1927, but Morgan made no claim before the Industrial Accident Board until May 31, 1930, nearly three years after the injury occurred.
