SAVOY, Judge.
This is an action in tort arising out of an automobile-pedestrian accident in Evangeline Parish, Louisiana. Kossuth C. Sally, (also spelled Kosuth C. Sales), was struck and killed by an automobile owned and being driven by the defendant, Joseph E. Guillory. Guillory’s liability insurer, New York Fire and Marine Underwriters, Inc., was joined as defendant. Plaintiffs are the six major children of the deceased, Kossuth Sally.
