OPINION

ROBERTS, Judge.

This is an appeal from a conviction for unlawful possession of marihuana. Trial was before a jury with punishment set by the jury at four years confinement.

At the outset, it appears that appellant’s brief was not timely filed in the trial court. The record was approved on November 16, 1970. On December 15, 1970, the trial court extended the time in which to file the brief until February 16, 1971. Appellant’s brief was not filed until February 25, 1971.
