This is a civil action brought by plaintiff Rickies, Inc., a cosmetics store, alleging violations of the Robinson-Patman Act (the Act). Rickies alleges that defendant Frances Denney Corporation (Denney), a manufacturer and distributor of cosmetics, gave favorable treatment to defendants Jordan Marsh Company and Federated Department Stores, Inc. (Bloomingdale’s) by providing the department stores with benefits that were withheld from small specialty stores, including Rickies.
