Patterson, J.:
This is an appeal from an order made at Special Term confirming the report of the commissioners of estimate and assessment in the *287above-entitled proceeding. By their fifth separate report they represented to the court that there had been taken for the purposes of the improvement, with carrying out which they were charged, a part of a block of ground situate in the twenty-third ward of the city of New York, and bounded by the Third avenue, Lincoln avenue, the Southern boulevard and the Harlem river.
