In my opinion the decision of the majority in this case is directly contrary, upon the point of the right to sue, to the case of Carrier Lumber & Mfg. Co. v. Quitman County, 156 Miss. 396, 124 So. 437, 438, 125 So. 416, 66 A. L. R. 614. In that case the suit was instituted by Quit-man county for taxes due the county by the lumber company upon certain lands in the county. The lands had been attempted to be sold, but the method of conducting the sale was alleged to have rendered the sale illegal and void. The lands had been struck off to the state,…
