Appellant Donna Ballard was tried for the first time with Robert Barnes on charges of conspiracy to import and to pos sess cocaine with intent to distribute, 1 importation of cocaine, 2 and possession of cocaine with intent to distribute. 3 Appellant was convicted of the conspiracy count and acquitted of the others. She was given a new trial on the conspiracy charge and again convicted.
