The question before this court for decision arises on a motion and an amended motion of the appellee, to dismiss the ap*395peal for the reason that the appellant has satisfied the judgment. In view especially of appellant’s contention that notwithstanding he may have satisfied the judgment, nevertheless he may prosecute his appeal from an order and judgment of the trial court sustaining a demurrer to his cross petition, it is necessary to review the record.
