MORRISON, Judge.

The offense is murder; the punishment, seven years.

Appellant and deceased spent ten turbulent years in marriage prior to the homicide. Deceased had during that time assaulted appellant on repeated occasions, and there had been temporary separations. On the day of the shooting, deceased was entertaining a number of his friends with a poker game and beer drinking in his home. Appellant was not participating in the game but was present in the room where it was in progress.
