This action of trespass on the case for negligence was tried to a justice of the superior court sitting without a jury and resulted in a judgment 1 of $576.50 plus costs for the plaintiff. It is here on the defendant’s appeal.

The facts are that plaintiff’s cellar was flooded with water to a depth of about eighteen inches following a break in the drainpipe which ran from the foundation of his residence to the street and which, until damaged, drew off any ground or surface water which might have accumulated in •the surrounding area.
