OPINION OF THE COURT

Memorandum.

The order of the Appellate Division should he modified, with costs, by denying plaintiff’s motion for summary judgment and reinstating defendant’s affirmative defenses of the statute of limitations and comparative negligence and, as so modified, affirmed.
