Plaintiff, Builder’s Concrete Co. of Morton, brought this breach of contract action against defendant, Fred Faubel and Sons, Inc., to recover unpaid rent and the cost of repairing certain vehicles which plaintiff leased to defendant under a written agreement. Defendant counterclaimed seeking liquidated damages for plaintiff’s refusal to convey the property under an option to purchase clause.
