This is an action for damages for personal injuries and destruction of wearing apparel caused by respondent slipping on some oil upon the sidewalk adjacent to the property occupied by appellant. The cause was tried to the court without a jury. At the conclusion of respondent’s case, a motion for nonsuit was denied, and the trial ultimately resulted in a judgment for respondent. Appellant thereafter moved for a new trial, and upon a denial thereof this appeal followed.
