This is another chapter of the litigation in Barton county over the proposed construction of good roads. When this case was here before (Hines v. Barton County, 106 Kan. 682, 68.7, 189 Pac. 369), it was held that where a benefit road district is sought to be created by a petition of the requisite number of qualified landowners, praying the board of county commissioners to construct an improved, hard-surfaced road if such can be done at a cost not exceeding $30,000 per mile, the county board cannot disregard this limitation touching the…
