The defendant has been indicted for the crime of murder in the first degree, alleged to have been committed on April 17,1953, when he was fifteen years of age. The indictment contains two counts, the first of which charges defendant with a violation of subdivision 2 of section 1044 of the Penal Law, in that, on April 17,1953, he committed an act imminently dangerous to others and evincing a depraved mind, regardless of human life, by pointing and discharging a loaded rifle at and in the direction of one Henry Benson and other persons then and there present, and that he shot and killed said…
