DYER, Chief Judge.

This cause is before the Court on the motion of the defendant, Elmer M. Harris, made pursuant to Title 28 U.S.C.A. § 2255, to set aside the judgment of con*772viction against him entered herein on February 9, 1960.

The defendant was charged in a thirteen count indictment with violations of Title 18 U.S.C., Sections 2 and 2314. After a two day trial the jury, on February 9, 1960, returned a verdict of guilty as to each count, and defendant was sentenced on February 19, 1960, to imprisonment for three years as to Counts 1, 2 and 3 to run concurrently.
