Appellant, W. J. Radney, was informed against for the murder of Eugene Lynch. He pleaded not guilty to the charge, and upon the trial the jury rendered a verdict of manslaughter in the first degree, but failed to agree on the punishment. In due course a motion for new trial was interposed in his behalf and denied, and he was sentenced to confinement in the penitentiary for a term of 20 years, and from the judgment duly pronounced by the court he appeals.
