Slanar v. Grumman Aerospace Corp.

Appellate Division of the Supreme Court of the State of New York

Decided July 17, 1980Published

1Opinion of the Court

Appeal from a decision of the Workers’ Compensation Board, filed May 15, 1979, which disallowed a claim for continued compensation. The sole issue before this court, pursuant to the stipulation of the parties, is whether the claimant voluntarily retired from employment. Quite obviously, this is a purely factual issue which the majority of the board answered in the affirmative. Since Dr. Cohen’s opinion, as well as other evidence, supports the decisions, it should be affirmed. Decision affirmed, without costs. Greenblott, J. P., Kane, Main and Herlihy, JJ., concur.
