Cross appeals from an order of the Supreme Court (Williams, J.), entered November 7, 2005 in Saratoga County, which, inter alia, partially granted the cross motion of defendants Linda J. Gioia and Robert Gioia for summary judgment dismissing the complaint.

In 1999, defendant Robert Gioia negotiated the purchase of a 1988 Advantage Warrior motorboat to be used for recreational purposes. Title was placed solely in the name of his wife, defendant Linda J.
