The above-entitled cause is now being determined on defendant’s appeal on question of law from the judgment of the Court of Common Pleas of Franklin County, Ohio.

On and before January 21, 1935, Arthur Miles, late husband of appellee, Eva P. Miles, was an employee of the Union Fork and Hoe Company, of Columbus, Ohio. The Union Fork and Hoe Company was on and prior to January 21, 1935, an employer within the meaning of the Workmen’s Compensation Act of Ohio and had complied with the provisions of the Act.
