The decedent died on February 22, 1930, leaving a will made on January 13, 1930. She left two infant children, one two years and the other four years of age,-residing with Jeanne *236it. Martens, the aunt. The petition for probate shows that the decedent was granted an absolute divorce from the father of the infants in the State of California and that the custody of the persons and estates of the said infants was awarded to the said decedent; that the infants have no general guardian and that the petitioner was named as testamentary guardian.
