This action was brought to recover from the defendant the sum of $950, the value of goods alleged to have been wrongfully taken from the plaintiff, and the further sum of $2,000, as damages sustained by plaintiff in his business by reason of the alleged wrongful taking of the goods. The plaintiff claims title to the goods under and by virtue of a purchase upon an execution sale, and at the trial the defendant moved for a dismissal of the complaint on the ground that the execution under which said sale took place was subscribed neither *271by the party issuing it, nor by…
