Error to the Court of Common Pleas of Philadelphia county, in an action for money had and received, brought by Mark Walker, the plaintiff below, against Nicholas Stafford, the defendant below. This is an action for money had and received, &e., brought by Mark Walker, the plaintiff below, against Nicholas Stafford, the plaintiff in error. The plaintiff, together with the defendant and eight others, formed themselves into a club, for the purchase of ten lottery tickets, in which they were to be equally concerned.
