The plaintiff in this case first filed an application on March 26, 1962, with the defendant, seeking to establish a period of disability under 42 U.S.C.A. § 416 (i) and for disability insurance benefits under 42 U.S.C.A. § 423. After hearings by the hearing examiner and review and the taking of additional evidence by the Appeals Council, the final decision of the Secretary of Health, Education and Welfare was a denial of the claimant’s application on January 29, 1964, on the grounds that claimant had unreasonably refused remedial surgery and therefore his impairment did…
