Wells owned a tract of 120 acres of land, on which he maintained his home, situated in Young county. The Texas Electric Service Company, a corporation engaged in the business of supplying electric current to its patrons invested with the right of eminent domain, instituted condemnation proceedings, as plaintiff, against Wells and his wife, Rosa Wells, as defendants, to acquire a right of way over their land.
