On February 16 -17 and 21-28, 2000, a bench trial was held in the above-styled case. Having considered the evidence in this case and the applicable law, the Court enters the following findings of fact and conclusions of law.
On June 23, 1995, Plaintiff Voest-Alpine Trading USA Corporation (“Voest-Al-pine”) entered into a contract with Jiangy-in Foreign Trade Corporation (“JFTC”) to sell JFTC 1,000 metric tons of styrene monomer at a total price of $1.2 million.
