DONAHUE, Circuit Judge.

W. E. Mackey, former postmaster at Neshoba, Shelby county, Tenn., was prosecuted upon an indictment charging embezzlement of money of the United States, derived from the sale of postal money orders, that had come into his possession and under his control as such postmaster. The indictment contained four counts.
