This is an action by a child eight years of age for being run over by a wagon of the defendant, driven by a servant of the defendant in the course of the defendant’s business. It appeared that -the plaintiff had been allowed by her mother to go out to play in the yard of the house where she lived; that she and her older sister played in the yard for a time, and then her sister suggested that they should play in the street, and they left the yard for that purpose.
