MEMORANDUM OPINION, FINDINGS OF FACT AND CONCLUSIONS OF LAW

Pending before the court is the trustee’s complaint to avoid as preferential transfers payments made by debtors to one defendant, Empire Bank, that benefitted defendants Ernest and Ella Hughes. The Hughes are grandparents of debtor Randall Al-dridge and guarantors under a note from debtors to Empire Bank. Two hearings were held in this matter.
