MEMORANDUM OPINION AND ORDER

Before the Court is Defendant James Jedynak’s post-trial motion for judgment *815of acquittal or, alternatively, for a new trial [132]. For the reasons set forth below, the Court grants Defendant’s motion for acquittal as to Count 3 and denies Defendant’s motion [132] in all other respects.
