CURTIS. Circuit Justice.

This is an action on the case for the disturbance of a right of common, of sea-weed, and of taking sea manure, claimed by the plaintiff in a lot of land near Point Judith, in the state of Rhode Island. The case has been submitted to the court on a statement of facts, which embraces the title papers under which the plaintiff claims the right described in the declaration. The defendant claims no title in himself, and admits the taking and carrying away of the sea-weed mentioned in the declaration, without the license and against the will of the plaintiff; but he denies…
